The Internet of Things (IoT) expresses the phenomenon of everyday objects able to interact with each other and with users, developing the potential inherent in the network in the direction of innovative applications that use information from the environment. From the IoT derives, in addition to an increase in data transmitted online, the emergence of new risks related to privacy, determined by the proliferation, by the crossover and by the advanced interpretation of data that lead to the almost automatic identification of individual profiles. In terms of mobility, we can outline the transition from the Infotainment Auto systems towards automated/connected car systems that provide for the connection of both vehicles to each other and both between these and the infrastructural context. The introduction of new-generation vehicles will lead to the initiation of new dynamics of threats to privacy and it will change the different implications and the degree of responsibility of the subjects involved, as well as the positions of stakeholders. Therefore, the need for a careful legal-normative consideration of the phenomenon in question is detected, as well as the need for a unitary reference regulatory framework, at a transnational level, that , taking into account the plurality of the subjects involved, and beyond the adherence to merely commercial development models, make a fair balance of the interests at stake, first of all by guaranteeing the fundamental rights of the person.
L’Internet of Things (IoT) esprime il fenomeno di oggetti di uso quotidiano capaci di interagire fra di loro e con gli utenti, sviluppando le potenzialità insite nella Rete in direzione di innovative applicazioni delle informazioni provenienti dall’ambiente. Dall’IoT deriva, oltre ad un aumento dei dati trasmessi on line, la nascita di inediti rischi per la privacy, determinata dalla proliferazione, dall’incrocio e dall’avanzata interpretazione dei dati che conducono alla pressoché automatica identificazione di profili individuali. A livello di mobilità, si può tratteggiare la transizione dai sistemi di Infotainment Auto verso sistemi di automated/connected car che prevedono la connessione ad internet sia dei veicoli tra loro, sia tra questi e il contesto infrastrutturale. L’introduzione dei veicoli di nuova generazione comporterà l’avvio di nuove dinamiche di minaccia alla privacy e muterà, altresì, la differente implicazione ed il grado di responsabilità dei soggetti interessati, tanto quanto le posizioni degli stakeholder. Viene, pertanto, rilevata, la necessità di un’attenta considerazione giuridico-normativa del fenomeno in questione, nonché l’esigenza di un quadro unitario di riferimento a livello transnazionale che, tenuto conto della pluralità dei soggetti coinvolti, ed al di là dell’aderenza a modelli di sviluppo meramente commerciali, effettui un equo bilanciamento degli interessi in gioco, nella primaria garanzia dei diritti fondamentali della persona.
