Legal Aspects of the Conclusion of the Next Generation EU Program The program, established by the Member States and the European institutions to address the economic consequences of the COVID-19 pandemic, is drawing to a close: the milestones set out in the funding programs that the Member States agreed upon with the European Commission must be completed by August 31, 2026. Beyond its economic impact, the program has nonetheless had determined some long-term consequences for the institutional framework of the Treaty. These can be summarized, first and foremost, in the creation of a method of governance characterized by strict conditionality and continuous contact between individual Member States and the European Commission; second, in a clearly extensive interpretation of the legal bases; and finally, in the abandonment – albeit only partial – of the strictly neoliberal logic that characterized the funds disbursed in the past by European institutions. Another question is whether the program could be proposed again in the future. Indeed, several obstacles within the Treaty prevent the use of debt as a regular financing tool for European policies. These can be found in Articles 311, 310, 123 and 125 TFEU. In this context, recourse to debt can therefore occur only under specific, time-limited circumstances that are already provided for in the Multiannual Financial Framework in effect at the time the debt securities are issued.
