Legislative Decree No. 121 of 2 October 2018 introduced a specific model for the enforcement of sentences against minors, centred on community-based criminal measures, as these are better suited to achieving the following objectives: promoting restorative justice programmes, accountability, education and the full psychological and physical development of the minor, preparation for life outside prison, social inclusion and the prevention of further offences (Art. 1). Starting from the principle – repeatedly expressed by the Constitutional Court – that the educational needs of the minor must always take precedence over the State’s punitive demands, given the limited, if not non-existent, educational capacity of prison, the provisions of Legislative Decree No. 121 of 2018 contain legislative choices that foreshadow the possibility of a punitive model capable of doing without prison or, in all cases where there is a ‘need for restrictive measures’ for extreme situations that require them, such measures should be implemented within custodial models that prioritise the vulnerability and educational needs of the minor, using methods and settings that respect and protect the individual above all else. This does not seem to be the time for criminal policy choices that go beyond prison, but the history of penal systems teaches us that no goal is unattainable.
La disciplina contenuta nel d.lgs. 2 ottobre 2018, n. 121 ha introdotto un modello peculiare di esecuzione della pena nei confronti di autori di reato minorenni, incentrato sulle misure penali di comunità perché meglio consentono di attingere gli scopi perseguiti: favorire i programmi di giustizia riparativa, la responsabilizzazione, l’educazione e il pieno sviluppo psicofisico del minorenne, la preparazione alla vita libera, l’inclusione sociale e prevenire la commissione di ulteriori reati (art. 1). Partendo dal principio – più volte espresso dalla Corte costituzionale – secondo cui le esigenze di crescita del minorenne debbano sempre prevalere rispetto alla pretesa punitiva dello Stato, attesa la scarsa, se non nulla, attitudine pedagogica del carcere, nelle norme del d.lgs. n. 121 del 2018 si rintracciano opzioni legislative che prefigurano la possibilità di un archetipo punitivo che possa fare a meno del carcere o in tutti i casi in cui vi fosse la “necessità di misure contenitive” per le situazioni limite che lo richiedessero, le misure dovrebbero inverarsi dentro modelli custodiali che mettano al primo posto la fragilità e le istanze educative del minorenne, ricorrendo a metodi e luoghi che rispettino e difendano prima di tutto la persona. Non sembra essere questo il tempo di scelte di politica criminale che vadano oltre il carcere, ma la storia della penalità ci insegna che non esistono traguardi irraggiungibili.
