Reflecting on the relationship between public administration and the public, we could observe, to borrow the words of an authoritative scholar, that “Administration that does not serve, does not serve.” This statement captures the current situation, giving us an idea of how the relationship between citizens and public administration should be. On closer inspection, this idea is very far from that rooted in the origins of administrative law and considered valid for a long time after the birth of public administrations in an era when citizens were considered subjects of the administration, which was in turn seen as the executive arm of the government, serving it rather than the community and citizens as holders of their own individual expectations. Much has already changed with respect to that model, thanks to important advances on the subject made by legal science, but also by case law and the legislature. The extent to which Massimo Severo Giannini's insights and reflections have influenced these advances is the subject of this article.
Riflettendo sul rapporto tra pubblica amministrazione e amministrati si potrebbe osservare, facendo proprio il gioco di parole di un autorevole studioso, che «L’amministrazione che non serve, non serve» . Questa affermazione fotografa l’attuale, restituendoci l’idea di come dovrebbe essere la relazione tra cittadino e pubblica amministrazione. Si tratta a ben vedere di un’idea molto lontana da quella radicata alle origini del diritto amministrativo e ritenuta valida per lungo tempo dopo la nascita delle amministrazioni pubbliche in un’epoca in cui il cittadino era considerato alla stregua di un suddito dell’amministrazione vista a sua volta come braccio esecutivo del governo, posta al suo servizio piuttosto che al servizio della comunità e dei cittadini quali titolari di proprie aspettative individuali. Rispetto a quel modello molto è già cambiato grazie agli importanti avanzamenti sul tema compiuti dalla scienza giuridica , ma anche dalla giurisprudenza e dal legislatore. Quanto e in che misura su questi progressi abbiano pesato le intuizioni e le riflessioni di Massimo Severo Giannini rappresenta l’oggetto di questo scritto.
