Il saggio analizza il rapporto tra filosofia del diritto e diritto positivo, che rappresenta uno dei nodi più complessi della riflessione giuridica contemporanea, soffermandosi in particolare sulla centralità dell’argomentazione giuridica e della responsabilità dell’operatore per affrontare le sfide che l’interpretazione giuridica pone nel presente.
