The Italian Constitution does not provide for extraordinary rules for the management of emergencies. In the case of the COVID 19 pandemic, a new organizational model was designed to enable rapid interventions in an ever-changing scenario envisaged to remain in force only until the end of the health emergency. The conclusion of the “state of emergency” (ended March 31, 2022) allows for a reflection on the compatibility of state and regional measures for managing the containment of the pandemic with the rules of the Constitution on the division of powers between the State and the Regions, and on the possible effects that this may have on the future of regionalism in Italy.

Abstract

The Italian Constitution does not provide for extraordinary rules for the management of emergencies.
