L'interpretazione "correttiva" del testamento: riflessioni comparatistiche tra diritto inglese e italiano

The interpretation of wills, based on different rules in the European legal systems, is mainly inspired by the purpose of gathering the true intention of the testator. The search for the testator's will, however, must take place in compliance with the legal requirements for the validity of the will, such as the testamentary form. Within this framework, the essay analyses from a comparative perspective the relationship between interpretation of the will and ‘integration’ of the will by the court, paying particular attention to the new forms of electronic wills recognized in various common law jurisdictions.

Le regole sull’interpretazione del testamento, pur nella diversità di approcci presenti nelle diverse esperienze giuridiche europee, sono principalmente ispirate alla finalità di attuare la volontà del testatore, consentendo di dare preminente rilievo alla volontà soggettiva dell’autore dell’atto di ultima volontà. La ricerca della reale volontà del testatore, tuttavia, deve svolgersi nel rispetto dei requisiti di validità del testamento previsti dalla legge, quale la forma testamentaria. In questo quadro di riferimento, il saggio analizza in prospettiva comparatistica il rapporto tra interpretazione del testamento e integrazione del testamento per via interpretativa ad opera del giudice, ponendo particolare attenzione alla nuove forme di testamento elettronico, riconosciute in vari ordinamenti di common law.
