Artificial intelligence is used in many fields nowadays, such as the judiciary. Here, these algorithms can be employed for different uses, for example to calculate the risk of recidivism or predict the outcome of a trial. Although these tools have already been implemented in different legal systems, they pose many problems in terms of risk of discrimination and crystallization of the law. Also, their influence on cognitive processes is not to be underestimated, as it has been shown to be quite difficult for a human to depart from the outcome of highly technical and autonomous devices. It will thus be necessary to balance the risk and benefits of these tools, questioning whether and to what extend they could be used in the decision-making process in a way compatible with the need for the law to be adaptable to new challenges.

Abstract
Artificial intelligence is used in many fields nowadays, such as the judiciary. Here, these algorithms can be employed for different uses, for example to calculate the risk of recidivism or predict the outcome of a trial. Although these tools have already been implemented in different legal systems, they pose many problems in terms of risk of discrimination and crystallization of the law. Also, their influence on cognitive processes is not to be underestimated, as it has been shown to be quite difficult for a human to depart from the outcome of highly technical and autonomous devices. It will thus be necessary to balance the risk and benefits of these tools, questioning whether and to what extend they could be used in the decision-making process in a way compatible with the need for the law to be adaptable to new challenges.File | Dimensione | Formato | |
