The essay examines the genesis and development of specialized environmental jurisdiction in India and in the People's Republic of China, given the economic and environmental importance assumed by the two countries in recent decades. Starting from the analysis of some environmental disasters that have reached the Indian Supreme Court, which has also innovated the rules of responsibility of the owner for damages caused by one's own assets, he then focuses on the stopping and resuming points of the development of the environmental judge specialized in India, going to compare the proposals that emerged there with the "Australasian" model of the environmental court. Looking then at China, we analyze the case of the maritime courts, the first judge with environmental powers removed from ordinary jurisdiction, and the development "from below" of specialized environmental courts on a local basis, which have not yet received the approval of the legislator. The two experiences will therefore be compared, tracing profiles of criticalities and opportunities that emerge from the establishment of specialized environmental courts.
Il saggio esamina la genesi e lo sviluppo della giurisdizione ambientale specializzata in India e nella Repubblica Popolare Cinese, data la rilevanza economica e ambientale assunta dai due Paesi negli ultimi decenni. Partendo dall’analisi di alcuni disastri ambientali giunti sino alla Corte suprema indiana, la quale ha altresì innovato le regole di responsabilità del proprietario per i danni cagionati attraverso i propri beni, successivamente si sofferma sui punti di arresto e di ripresa dello sviluppo del giudice ambientale specializzato in India, andando a raffrontare le proposte lì emerse col modello “australasiano” di corte ambientale. Guardando poi alla Cina, si analizza il caso delle corti marittime, primo giudice con competenze ambientali sottratte alla giurisdizione ordinaria, e lo sviluppo “dal basso” di corti ambientali specializzate su base locale, che non hanno ancora ricevuto l’approvazione del legislatore. Le due esperienze saranno dunque comparate, tracciando profili di criticità e di opportunità che emergono dall’istituzione di corti ambientali specializzati.
