It is frequently stated that culture represents an “essential ingredient” of territorial development, the so-called fourth pillar of sustainable development. Into which legal institutions are these statements translated? What rules does the law provide for these principles to be translated into concrete actions? What are the driving factors indispensable for those practices to be replicable? The aim of the essay is to answer the following questions from the specific perspective of inner areas, with the aim of verifying whether, and under what conditions, the application of the circular economy (and of the cultural heritage reuse) can contribute to a more sustainable enhancement of cultural heritage and whether benefits for the development of these territories can derive from this. The first part of the work is dedicated to the relationship between cultural heritage and sustainability in the multilevel system. In the central part of the work the discipline of the enhancement of the cultural heritage of the internal areas is analyzed, to highlight the reasons for their specialty, with particular regard to the themes of reuse and regeneration. The thesis that we intend to demonstrate is that (with regard to the cultural heritage of the internal areas), a revision of enhancement tools is necessary, through the reference to the principles of the international legal system and to legal tools outlined outside the Code of cultural heritage, which show an ever clearer affirmation of the tools of reuse and regeneration also with regard to cultural heritage.
