This paper aims to investigate the relationship between senatorial decrees and laws, with main reference to the final stages of the libera res publica, highlighting the effectiveness of senatus consulta and how such decrees can already be fully counted among the sources of law for this period and how, above all, the well-known quaestio mentioned by Gaius can be traced back to the post-Sullan political conflicts or, at the latest, to the atmosphere of deep political instability that arose again in the year 43 BC.
