The paper - included in a special discussion around the biography of W.G. Sebald, by Carole Angier - aims to explore the possible relevance of Sebald’s discourse for a reflection on law and on legal history in relation to the study of transitional justice. By means of an itinerary on the emergence of memory, the paper focus on the issue of "restitution" and the "right to resentment" in order to consider: the relevance of a victimological reconstructive viewpoint; the possibility of a change of focus more attentive to the dynamics of re-opening rather than re-composition of conflict; the opportunity to study the situational value ad the impermanent character of the solutions achieved by way of transitional justice.
