Stato di diritto e ordine sociale: il costituzionalismo bifronte di Robert von Mohl

A reconstruction of the context in which the Rechtsstaat was conceived, namely Germany in the 1848 revolution, will show how for Robert von Mohl and the other exponents of liberalism with leading roles in the Constituent Assemblies of Frankfurt and Berlin, the ideal of citizen’s autonomy referred only to the members of bourgeois society. The affirmation of the Rechtsstaat as a value and basic rule for the society of Besitz und Bildung did not exclude in their plans the maintenance of the traditional Polizeistaat for the lower classes. Indeed, the hidden face of the rule of law was the preventive justice devoid of legal guarantees and oriented according to racial and class prejudice, with which Mohl intended to create the preconditions for the social domination of the Mittelstand. The two-faced nature of the liberal constitutional programme will cost the Constituent Assemblies the loss of popular support.

Ricostruendo il contesto in cui era stato ideato lo Rechtsstaat, dunque la Germania nella rivoluzione del 1848, si dimostrerà come per Robert von Mohl ed altri esponenti del liberalismo con ruoli di primo piano nelle Assemblee Costituenti di Francoforte e Berlino, l’ideale di autonomia privata del cittadino si riferiva solo ai membri della società borghese. L’affermazione dello Rechtsstaat come valore e regola base per la società di Besitz und Bildung non escludeva nei loro piani il mantenimento dello tradizionale Polizeistaat per le classi subalterne. Anzi, il volto nascosto dello stato di diritto era la giustizia preventiva priva di garanzie legali e orientata secondo pregiudizi razziali e di classe, con cui Mohl intendeva realizzare le precondizioni per il dominio sociale dello Mittelstand. Questa natura bifronte del programma costituzionale liberale costerà alle Assemblee Costituenti la perdita del sostegno popolare.
