This study analyses the legal regime of the “Gaza Sea” under international law since the accession of the State of Palestine to the United Nations Convention on the Law of the Sea on 2 January 2015. Following this accession, on 24 September 2019, the State of Palestine notified the United Nations Secretariat the coordinates of its maritime boundaries specifying the extension of its territorial sea, contiguous zone, exclusive economic zone, and continental shelf. The paper focuses three fundamental issues: the legal regime of Palestine's maritime zones, the maritime delimitation disputes between Palestine and States with opposite or adjacent coasts and the legal regime of the living and mineral resources of the waters adjacent to the Gaza Strip. Nonetheless, the legal status of the sea off the coast of Palestine can only be assessed from the particular circumstances that regard the Palestinian territory as a territory under military occupation since 1967.

Cette étude effectue une analyse du régime juridique de la « mer de Gaza » selon le droit international après l’adhésion de l’État de Palestine, le 2 janvier 2015, à la Convention des Nations unies sur le droit de la mer. À la suite de cette adhésion, le 24 septembre 2019, l’État de Palestine a notifié au Secrétariat général des Nations unies les coordonnées de ses frontières maritimes en spécifiant l’extension de la mer territoriale, de la zone contiguë, de la zone économique exclusive et du plateau continental. L’étude est axée sur trois questions fondamentales : le régime juridique des zones maritimes de la Palestine, les contentieux des délimitations maritimes entre la Palestine et les États adjacents ou qui se font face et le régime juridique des ressources biologiques et minières des eaux adjacentes à la Bande de Gaza. Toutefois, le statut juridique de la mer au large de la Palestine ne peut être évalué qu’à partir des circonstances particulières qui concernent le territoire palestinien en tant que territoire sous occupation militaire depuis 1967.
