Fundamental rights are investigated by Niklas Luhmann from the point of view of their function with respect to the legal system as well as to the overall social system. Their function is to ensure the nexus and communicative differentiation between the political and juridical systems, which mirrors that between the political system and the society. Through fundamental rights, the political system avoids to extend its sphere of competence to the different spheres of public communication, excluding from its potential domination social phenomena that do not belong to it and consolidating the State bureaucratic structure. Human rights play a crucial role in Luhmann’s theory insofar as, by including a source of legal legitimacy external to the legal system, consisting in the scandal generated in public opinion by the violation of human rights, they expose the legal system to the potential loss of its functional specificity.
I diritti fondamentali sono analizzati da Niklas Luhmann in base al loro ruolo in relazione al sistema giuridico, nonché in relazione al sistema sociale nel suo insieme. La loro funzione consiste nel garantire il collegamento e la differenziazione comunicativa tra il sistema politico e il sistema giuridico, riflettendo la relazione tra il sistema politico e la società. Il sistema politico evita, attraverso i diritti fondamentali, di estendere la propria sfera di competenza alle diverse sfere della comunicazione pubblica, liberando dal suo potenziale dominio i fenomeni sociali e consolidando la struttura burocratica statale. I diritti umani costituiscono un momento cruciale nella teoria di Luhmann poiché, inserendo una fonte di legittimazione normativa esterna al sistema giuridico, identificata dall'autore nello scandalo generato nell'opinione pubblica dalla violazione dei diritti umani, espongono il sistema giuridico stesso al rischio della perdita di specificità funzionale.
