Moving from the "core business" of Taricco case, the aim of the present work is to carry out some reflections on the relationship between political power and judicial power – that is a traditional issue of constitutional studies - especially in the current context that is characterized by many and deep constitutional changes. In particular, it is interesting to investigate the reasons why judicial power seems to conquer more ground on political power in those jurisdictions, as Italian one, that are traditionally referable to the civil law. After all, the reflections will slip on the level related to the role of constitutional courts – as bodies ab origine located in the middle between the political and the jurisdiction - in the supranational perspective. Thus, returning to the Taricco case, which therefore confirms as meaningful in a multiple points of view.
Muovendo dal “core business” del caso Taricco, cioè il rapporto tra la legislazione e la giurisdizione, con il presente lavoro si vogliono svolgere alcune considerazioni sul rapporto tra potere legislativo e potere giudiziario, tema classico degli studi costituzionalistici, che vadano a indagare, in particolare, le ragioni per le quali, nel nostro come in altri ordinamenti tradizionalmente riconducibili al civil law, il secondo pare conquistare sempre più terreno sul primo. Considerazioni che, in conclusione, scivoleranno sul piano relativo al ruolo delle Corti costituzionali - organi ab origine tra il politico e il giurisdizionale, e dunque strutturalmente“di confine” - nella prospettiva sovranazionale, tornando così al caso Taricco che si conferma, pertanto, denso di significati sotto molteplici punti di vista.
