The present paper addresses the rules on jurisdiction contained in Regulation (EU) No. 2016/679 concerning the protection of natural persons with regard to the processing of personal data. These rules appear instrumental to the pursuit of the fundamental goal of guaranteeing an effective judicial protection of the rights granted to individuals as concerns the processing of their personal data against those subjects who are responsible for the said processing. These rules, welcome as they are in their purpose of providing special fora expressly tailored in respect of the peculiarities of the litigation concerned, fall short of addressing adequately the problems of coordination which they raise in respect of the rules on jurisdiction in civil and commercial matters as currently set out under Regulation (EU) No. 1215/2012 (s.c. “Brussels Ia” Regulation).

Abstract

The present paper addresses the rules on jurisdiction contained in Regulation (EU) No. 2016/679 concerning the protection of natural persons with regard to the processing of personal data. These rules appear instrumental to the pursuit of the fundamental goal of guaranteeing an effective judicial protection of the rights granted to individuals as concerns the processing of their personal data against those subjects who are responsible for the said processing. These rules, welcome as they are in their purpose of providing special fora expressly tailored in respect of the peculiarities of the litigation concerned, fall short of addressing adequately the problems of coordination which they raise in respect of the rules on jurisdiction in civil and commercial matters as currently set out under Regulation (EU) No. 1215/2012 (s.c. “Brussels Ia” Regulation).
