In what could be defined as a “senile technological age of rights”, growing demographic aging and technical-scientific innovation are pushing the private sector to develop new solutions capable of recognizing and understanding “facts increasingly responsive to the needs of older individuals”. Between the absence of a specific discipline to protect the elderly and the reconduction of the same within a rigid legal category, this thesis aims to examine the new legal technique “suited to” and “tailored to” senility, with the aim of providing adequate protection to the senior in need, without falling into any form of categorization. If the current legislation proves to be adequate in providing sufficient protection, the existing law is, in fact, “suited to” the elderly (rectius, “suited to” cases that meet the current needs of the elderly) and must therefore be applied in practice; where, instead, a real lack of legislation is detected, or an insufficiency of protection on the basis of the current legislation, the right cannot, instead, be considered “suited to” the elderly, making it necessary to prepare a right “tailor-made for” the elderly (rectius “tailor-made” to deal with facts responding to the current needs of the elderly), applied not on the basis of age, but of the concrete circumstances. Using this technique, this thesis analyzes the three areas of greatest interest for the elderly, represented by personal, patrimonial, and testamentary autonomy, well-being, and new technologies. The examination of these fields is, moreover, always carried out by adopting an inductive, interdisciplinary, ethical, anthropocentric and sustainable method.
In quella che potrebbe definirsi una “senile era tecnologica dei diritti”, il crescente invecchiamento demografico e l’innovazione tecnico-scientifica spingono il settore privatistico ad elaborare nuove soluzioni in grado di riconoscere e ricomprendere “fatti sempre più rispondenti ai bisogni di individui in età avanzata”. Tra l’assenza di una specifica disciplina a tutela dell’anziano e la riconduzione del medesimo all’interno di una rigida categoria giuridica, il presente lavoro di tesi mira a vagliare la nuova tecnica del diritto “a misura di” e “su misura per” la senilità, allo scopo di fornire adeguata protezione al soggetto senior che ne abbia bisogno, senza cadere in alcuna forma di categorizzazione. Se la normativa vigente si rivela idonea a fornire adeguata tutela, il diritto esistente è, infatti, “a misura” di anziano (rectius “a misura” dei casi rispondenti a bisogni attuali dell’anziano) ed esso dovrà, dunque, trovare concreta applicazione; laddove venga, invece, rilevata una vera e propria mancanza normativa, ovvero un’insufficienza di tutela sulla base della disciplina vigente, il diritto non potrà, invece, esser considerato “a misura” di anziano, rendendosi necessaria la predisposizione di un diritto “su misura per” l’anziano (rectius “su misura” per fronteggiare i fatti rispondenti a bisogni attuali dell’anziano), applicato non sulla base del mero dato anagrafico, ma delle concrete circostanze. Impiegando tale tecnica, sono, quindi, analizzati nel presente lavoro di tesi i tre ambiti di maggiore interesse per l’anziano, rappresentati dall’autonomia personale, patrimoniale e testamentaria, dal benessere e dalle nuove tecnologie. La disamina di tali campi è, peraltro, sempre effettuata adottando un metodo induttivo, interdisciplinare, etico, antropocentrico e sostenibile.
