The medieval concept of public justice also includes aspects of dispute that today appear to be of a private nature. This essay aims to identify, in the doctrinal representation of the trial, the theoretical and systematic categories used to organise this complexity. After a general overview, the discussion focuses on certain procedural mechanisms (arbitrium procedendi, transactio and pax) that are particularly illustrative of these perceptions, before concluding with some reflections on the role of the jurist in structuring the relationship between justice, politics and the legal order.

Abstract

The medieval concept of public justice also includes aspects of dispute that today appear to be of a private nature. This essay aims to identify, in the doctrinal representation of the trial, the theoretical and systematic categories used to organise this complexity. After a general overview, the discussion focuses on certain procedural mechanisms (arbitrium procedendi, transactio and pax) that are particularly illustrative of these perceptions, before concluding with some reflections on the role of the jurist in structuring the relationship between justice, politics and the legal order.
