The awarding of the 2008 Olympics to Beijing and the accession of People’s China into the World Trade Organization raised hopes among many commentators, especially Western ones, that these openings to the world would result, through as well as the adoption of the technologies of the third industrial revolution, in the rapid propagation of ideas of liberalization in the distribution of cultural and creative products and, ultimately, of liberal and democratic values. These brief notes aim to examine the changes that have occurred in the regulation and distribution of cultural and creative products, especially those distributed digitally, in the decades from the 2008 Summer Olympics to the 2022 Winter Olympics. In particular, the evolution and refinement of a digital legal system that was previously jagged and uncertain and is now capable, through the exploitation and implementation of new technologies, of further restricting economic freedoms and fundamental rights related to cultural and creative activities will be highlighted.
L’assegnazione delle Olimpiadi del 2008 a Pechino e l’accesso della Cina popolare nella World Trade Organization hanno suscitato in molti commentatori, specie occidentali, la speranza che queste aperture al mondo avrebbero comportato, tramite pure l’adozione delle tecnologie della terza rivoluzione industriale, un rapido propagarsi delle idee di liberalizzazione nella distribuzione dei prodotti culturali e creativi e, da ultimo, dei valori liberali e democratici. Queste brevi note si propongono di esaminare i cambiamenti avvenuti nella regolamentazione e nella distribuzione dei prodotti culturali e creativi, specie di quelli distribuiti digitalmente, nei decenni che vanno dalle Olimpiadi estive del 2008 a quelle invernali del 2022. In particolare, si evidenzierà l’evoluzione e il perfezionamento di un sistema giuridico digitale prima frastagliato e incerto e ora capace, attraverso lo sfruttamento e l’implementazione delle nuove tecnologie, di limitare ulteriormente le libertà economiche e i diritti fondamentali legati alle attività culturali e creative.
