Since its founding on October, 1 1949 People’s Republic of China has undergone profound, radical and experimental transformations along with a unique modernization process. Best described by the concept ‘with Chinese characteristics’ (中国特色 – zhongguo tese) the country successfully transitioned from a non-market low income to a highly industrialized economy. The institutions devoted to constructing this unique path underscored the importance of preserving and maintaining the Chinese foundations while using ‘Western’ knowledge (中体西用 – zhongti xiyong). The peculiarity of the China’s path to modernization is highly debated and discussed both within and outside the country. This research contextualizes the positive legal phenomenon within its social, philosophical, and cultural dimensions, with a focus on the encounters between China and West and China and Global South countries. It explores how power has been has been bounded, exercised, and constructed in China and how such view is challenging neoliberal modernity. The overall objective of this research is to understand the challenges posed by China’s attempt to offer an alternative and unique path to modernity and understand how this path is being followed, transplanted and mimicked. The research stresses the importance of putting into dialogues diverging and opposing conceptualization of how state society relations and of how power has been bounded and enacted in these areas with different goals in mind. It combines textual analysis of sources in Chinese and English, with a doctrinal and comparative analysis of international economic laws, policies and regulations. The economic sphere is where the power of China is mostly formalized and structured and where, as demonstrated with the case study on the Belt and Road Initiative, we can see how Chinese view towards modernity power outside its national borders. The BRI acts as a container where legal encounters with other countries take place and where China could experiment and influence the direction of legal developments and economic reforms. The research focuses on a comparative legal analysis of four key policy areas - Cybersecurity, Special Economic Zones, Energy and, Emerging Technologies - to understand the challenges opened by China to the international order and, to examine the expansive nature of Chinese power in Global South countries.
Dalla sua fondazione, il 1° ottobre 1949, la Repubblica Popolare Cinese ha subito trasformazioni di natura profonda e radicale proponendosi anche come modello di un processo di modernizzazione unico nel suo genere. Aderendo alle line guida del nuovo modello di sviluppo meglio descritto del concetto di "con caratteristiche cinesi" (中国特色 – zhongguo tese), il paese è diventato una potenza globale. Le istituzioni dedicate alla costruzione di questo percorso unico hanno sempre sottolineato l'importanza di preservare e mantenere le basi cinesi utilizzando la conoscenza "occidentale" (中体西用 - zhongti xiyong). La peculiarità del percorso di modernizzazione della Cina è molto dibattuta e discussa sia all'interno che all'esterno del Paese. Questa ricerca contestualizza il fenomeno giuridico positivo all'interno delle sue dimensioni sociali, filosofiche e culturali, con un focus sugli incontri tra Cina e Occidente e Cina e paesi del Sud Globale. Altro intento di questo studio è l’esplorazione di come in Cina il potere sia stato limitato, esercitato e costruito e come tale visione stia mettendo in discussione la modernità neoliberista. L'obiettivo principale di questa ricerca è comprendere le sfide poste dal tentativo della Cina di offrire un percorso alternativo e unico alla modernizzazione e capire come questo percorso venga seguito, trapiantato e imitato. La ricerca sottolinea l'importanza di mettere in dialogo concettualizzazioni divergenti e opposte su come le relazioni della società statale e il potere siano stati delimitati e attuati in queste aree con obiettivi diversi in mente. Combina lo studio testuale delle fonti in cinese e inglese, con un'analisi dottrinale e comparativa delle leggi, delle politiche e dei regolamenti economici internazionali. La sfera economica è dove il potere della Cina è per lo più formalizzato e strutturato e dove, come dimostrato con il caso di studio sulla Via della Seta - Belt and Road Initiative, possiamo vedere come la Cina guarda al potere della modernità al di fuori dei suoi confini nazionali. La BRI funge da contenitore in cui si svolgono incontri legali con altri paesi e dove la Cina potrebbe sperimentare e influenzare la direzione degli sviluppi legali e delle riforme economiche.
