The paper aims at investigating the legal challenges, at the European Union level, related to access to non-personal data in the context of digital agriculture. The paper finds that a comprehensive legal framework for non-personal data in the EU is required in order to prevent unfair business practices and power abuse across the agrifood chain. In particular, the papers considers the possibility to design a ‘data producer’s privilege’, potentially following the pattern set out by the ‘farmer’s privilege’ in plant variety protection.
