With the spread of new forms of media, the public space has undergone profound transformations that require a rethinking of the constitutional paradigms on freedom of expression. Whilst in the tradition of liberal states, the pluralism of sources suffices to guarantee the right to information, new phenomena such as information overload, the speed of data transmission, the filter bubble and the echo-chamber effect, have brought new failties to light in the context of a connected and digital world. Among these, open societies are particularly vulnerable to disinformation campaigns orchestrated from abroad as a function of international political strategy. The European Union has adopted policies against disinformation to protect the resilience of democratic societies: most recently, in the context of sanctions introduced following the invasion of Ukraine, a decision was taken, for the first time, to suspend broadcasting of Russian media channels, as ecosystems of propaganda. The decision does not lack proportionality. However, solid democratic legitimacy would be desirable for the supranational adoption of measures which may significantly affect fundamental rights.
