La voce dei testimoni e la scrittura dei notai. Forme e pratiche documentarie in alcune inchieste giudiziarie della Marca anconetana (sec. XIII)

This essay examines the professional activity of notaries in major judicial inquiries held in the March of Ancona during in the second half of the 13th Century. Indeed, notaries were responsible for the drafting and the organization of witness statements: they then translated on the written page the spoken word. This essay investigates this practice particularly through three issues. The first issue examines the relationship between the voices of witnesses and the written text and investigates the practices of verbalization. The second one, indeed, aims to explore the connections between notarial writing and the willpower of witnesses to signify the judicial ‘truth’. The third issue concerns the documentary tradition of investigations: the given word and the writing are placed in a circular relationship, rich in references and involvements. This relationship gives shape to a chain of writings, able to connect several voices, different activities, a plurality of actors, fixing them within specific documentary forms.

Il saggio esamina l’attività professionale dei notai all’interno di importanti inchieste giudiziarie svoltesi nella Marca di Ancona nella seconda metà del XIII secolo. I notai erano infatti deputati alla stesura e all’organizzazione delle deposizioni testimoniali e traducevano dunque sulla pagina scritta la parola parlata. Nell’indagare tale pratica il testo appunta principalmente l’interesse su tre questioni. La prima esamina la complessa relazione fra la voce dei testimoni e il testo scritto, investigando le pratiche della verbalizzazione. La seconda mira invece a indagare, attraverso significative spie linguistiche e lessicali, la tensione fra la scrittura notarile e la volontà dei testimoni di sostenere una ‘verità’ sul piano giudiziario. La terza, infine, investe la tradizione documentaria delle inchieste: fra la parola data e la scrittura si instaura infatti un rapporto circolare, ricco di rimandi e di implicazioni; tale rapporto dà forma a una catena di scritture, capace di collegare più voci, diverse attività, una pluralità di attori, fissandoli entro specifiche forme documentarie.
