L'irruzione della storia negli statuti comunali marchigiani (secoli XIV-XV)

This essay assesses town statutes as a source of civic history, understood in a political and institutional sense. The civic legislation does not consist solely of a series of strict rules with legal value, instead the intrusion of history denotes its porosity. In the statutes there are hidden traces from which real political agendas emerge, such as the succession of regimes or the relations with higher level powers. This research aims to demonstrate how civic history creeps into the statutes, by modifying or directing the text. The existence of true historical references scattered here and there is useful to show how the statutes are the result of forms of adjustment which were dictated by the communities and their rulers. The examples all concern the Marche, a region which had an abundance of town statutes at the end of the Middle Ages. The examination of these traces, implicit or explicit, referring to current or past events, shows overall that the statute is a flexible instrument, which, as the source of the law, is able to embrace within itself the threads of civic history and then subsequently to unravel them.

Il saggio muove dalla constatazione che gli statuti comunali racchiudono in sé il portato della storia cittadina, intesa nell’accezione politico-istituzionale. Se i testi normativi non si risolvono in una serie di rigide norme dal valore giuridico, l’irruzione della storia denota invece la loro porosità : all’interno di essi si annidano tracce che fanno affiorare istanze politiche concrete, quali il susseguirsi dei regimi o il rapporto con i poteri sovraordinati. L’indagine si prefigge di verificare come la storia cittadina si insinui all’interno degli statuti, modificando o orientando il testo. La presenza di riferimenti storici concreti, disseminati qua e là, appare utile a mostrare come lo statuto sia il risultato di forme d’adattamento imposte dalla comunità e dai suoi governanti. Gli esempi presi in esami si riferiscono alla Marche, una regione ricca di statuti cittadini alla fine del medioevo : l’analisi delle tracce, esplicite o nascoste, riferite all’attualità o al recente passato, dimostra complessivamente come lo statuto sia un duttile strumento, capace di accogliere in sé e di dipanare, quale fonte del diritto, i nodi della storia cittadina.
