Obblighi di prevenzione dei conflitti e meccanismi istituzionali della prevenzione

This paper examines the phenomenon of “conflict prevention” from the perspective of international law. This evaluation focuses on two aspects: the identification of obligations of conflict prevention of the subjects of the international system as part of general international law and the analysis of the main tools of conflict prevention available in the UN system. In addition, some references are made to the role of regional organizations in conflict prevention, with particular attention to the EU position. The framework set shows that, beyond some international obligations, conflict prevention is essentially an instrument whose effective use depends on the choices of political opportunity of the various stakeholders involved and on the definition of a coherent legal and institutional structure.
