Il volume è a cura di Domenico Priori The present paper deals with an hitherto unstudied version of Francis of Appignano’s q. 37 on the Fourth Book on the Sentences. Besides confirming what scholarship already knows about Francis’ views concerning the origins of dominium, property and political power, this text allows a further insight in his political opinions in the early Twenties of the Fourteenth century, before the outbreak of the crisis between the Pope and Michael of Cesena in 1328. On one hand, Francis of Appignano seems to share one of the main tenets of curial politics during the Avignon period of the Papacy, that is, that Roman Pontiff is legitimated to exercise imperial power when the Empire is vacant. On the other hand, Francis, referring also to an anecdote about the Bolognese school of civil law, maintains that the Emperor is not the owner of the goods belonging to his subjects, but the authority that guarantees the exercise of property rights according to law and justice.
